WFIA is working with staff at the Employment Security Department to address employer concerns about the Paid Family and Medical Leave (PFML) system. Several systemic issues make it difficult for employers to properly manage employee leave and maintain accurate records. These issues also contribute to significant human resources challenges, increased legal expenses, employee/employer disputes, and, in some cases, serious operational disruptions. This includes delayed employer notification of PFML applications and approvals; a lack of clarity regarding the type of leave being requested; and significant delays between the notice date, response period and employer portal access.
WFIA believes one step ESD could take to help employers is to establish a dedicated account managers or employer support representatives for businesses. Employers are currently spending excessive amounts of time waiting on hold, navigating the system, and attempting to obtain answers. In some instances, employers are reportedly disconnected or timed out before they can resolve the issue.
For small and independent employers, particularly those operating on extremely narrow profit margins, these administrative challenges have a very real financial impact. When an employer is unexpectedly missing an employee, the cost of finding replacement workers, paying overtime, managing schedules, and maintaining operations can be substantial.
At the same time, employers need confidence that the PFML system is providing accurate and timely information so they can appropriately administer employee leave and comply with their legal obligations.
WFIA is also concerned about reports of employees receiving PFML benefits while working. Our members have provided examples of situations in which they believe an employee may have been receiving benefits while actively working.
We understand that ESD must investigate claims and protect employee privacy; however, employers need to know that there is an effective process for identifying, investigating, and resolving potentially fraudulent or inaccurate worker claims. The process of protesting claims needs simplification and clarity.
WFIA members want to comply with PFML requirements and properly support their employees. However, the current communication and access issues are creating significant operational, administrative, and legal challenges for employers.
